The incident occurred around 8:30 p.m. on Highway 33, north of Crows Landing Road, when Benjamin, from Newman, ran into the path of an oncoming vehicle while he and his father, Elvis Zepeda, were standing on the shoulder of the road near a food truck. Elvis chased after his son, but tragically, Benjamin was struck by a northbound BMW. The driver of the BMW immediately stopped and attempted to assist, but after the accident, Benjamin’s father retrieved a handgun and fired multiple shots at the vehicle. The driver was unharmed but fled the scene.
Benjamin was quickly transported to Doctors Medical Center with severe injuries, but despite efforts to save him, he passed away from his injuries.

The Arrest of Elvis Zepeda
Following the incident, the California Highway Patrol (CHP) launched an investigation. Modesto CHP and the Stanislaus County Auto Theft Task Force identified Benjamin’s father, Elvis Zepeda, as the shooter. He was arrested and booked into the Stanislaus County Public Safety Center on charges including attempted murder, possession of an illegal firearm, and possession of a controlled substance.
